Acceptable Use Policy

This Acceptable Use Policy sets the rules for using the Clear AI Studio platform and services — including our messaging, Voice AI, and automation tools. It applies to every client and user. Using our services means you agree to these rules.

Section 01

Purpose

Clear AI Studio, LLC provides AI-powered communication and automation tools that act on behalf of businesses. Because those tools can send messages, place and answer calls, and process customer data at scale, responsible use is essential — both to protect the people your business contacts and to keep our platform and sending reputation healthy for all clients.

This policy supplements our Terms of Service and SMS Terms. If you violate it, we may suspend or terminate your access as described in Section 6.

Section 02

Prohibited Uses

You may not use Clear AI Studio services to:

  • Violate any applicable law or regulation, including TCPA, CAN-SPAM, CCPA/CPRA, HIPAA, or FTC rules
  • Send unsolicited messages (spam) to anyone who has not given express consent
  • Contact numbers on the National Do Not Call Registry without a valid exemption or consent
  • Impersonate any person, business, or entity, or misrepresent your affiliation with one
  • Transmit content that is unlawful, fraudulent, deceptive, harassing, defamatory, obscene, or hateful
  • Promote illegal goods or services, or content prohibited by carrier and CTIA messaging guidelines (e.g., illegal substances, certain regulated financial or adult content)
  • Upload malware, attempt to breach security, probe, or disrupt our platform or its infrastructure
  • Reverse-engineer, copy, resell, or sublicense our services without written authorization
  • Infringe the intellectual property or privacy rights of others (see our DMCA / IP Policy)
Section 03

Messaging Rules (SMS & Voice)

Because messaging carries the highest compliance risk, these rules are strict and non-negotiable:

  • Consent first. Only message contacts who have given express written consent, captured through compliant opt-in. Pre-checked boxes are never valid consent.
  • No purchased lists. You may not upload purchased, rented, or scraped contact lists for automated messaging.
  • Honor opt-outs. STOP requests must be honored immediately and permanently; opt-out records are retained.
  • Accurate identity. Every message must clearly identify the sending business.
  • Registered campaigns only. All SMS runs through registered A2P 10DLC campaigns — never personal numbers or unregistered routes.
⚠ Compliance Sits With You

We provide the technology and compliance infrastructure. The legal responsibility for who you contact and what you send remains with you as the business operator. TCPA violations can carry fines of $500–$1,500 per message.

Section 04

Data & Security

  • Only upload contact data you have a lawful basis to use, and only for the purpose disclosed to those contacts
  • Do not place protected health information (PHI) into SMS content; healthcare clients must use a HIPAA-configured setup (see HIPAA Notice)
  • Keep your login credentials confidential; you are responsible for all activity under your account
  • Do not attempt to access another client's account, data, or sub-account
Section 05

Your Responsibility

You are responsible for the conduct of everyone who accesses your account, and for the content of every message, call, and automation you run through our platform. You agree to indemnify Clear AI Studio for claims arising from your misuse of the services, as set out in our Terms of Service.

Section 06

Enforcement

If we believe you are violating this policy, we may, at our discretion and without prior notice where necessary to protect the platform or third parties:

  • Pause or throttle messaging or calling on your account
  • Suspend access pending investigation
  • Terminate your account for serious or repeated violations
  • Report unlawful activity to carriers, regulators, or law enforcement

You remain responsible for fees accrued before suspension or termination. We are not liable for losses resulting from enforcement actions taken in good faith.

Section 07

Reporting Abuse

If you believe someone is misusing our platform — for example, sending you messages you never consented to — please tell us so we can investigate. Email [email protected] with details (the sending number, message content, and date if available). To stop messages immediately, reply STOP to any text.
