SMS Terms & Conditions

This page governs all text message programs operated by Clear AI Studio, LLC — both for our own communications and on behalf of client businesses using our AI platform. Read this before opting in to any messaging program.

Section 01

Program Name

The messaging programs operated by Clear AI Studio, LLC are collectively referred to as the "Clear AI Studio SMS Messaging Program."

This covers all automated text messages sent by Clear AI Studio on its own behalf — for marketing, scheduling, and client communication — and all automated messages sent on behalf of Clear AI Studio's business clients through our AI-powered platform.

✦ A2P 10DLC Registration

All SMS messages sent through our platform use registered A2P 10DLC campaigns. We do not send messages through personal (P2P) phone numbers or unregistered short codes. Registered campaign use cases include: Customer Care, Appointment Reminders, Marketing, and Transactional Notifications.

Section 02

Message Frequency

Message frequency varies based on the program and your interactions. Typical frequencies by message type:

  • Appointment reminders: Up to 3 messages per appointment (confirmation, 24-hour reminder, 1-hour reminder)
  • Lead follow-up sequences: Up to 5 messages over a 7-day period after initial inquiry
  • Marketing messages: No more than 4 messages per month per active campaign
  • Customer care: As needed in response to your inquiries — typically within 60 seconds
  • Review requests: 1 message per completed appointment or service
  • Recall / reactivation: Up to 2 messages per 90-day period for inactive contacts

You will always be informed of message types at the time of opt-in.

Section 03

Message & Data Rates

Message and data rates may apply. The cost of receiving text messages depends on your mobile carrier plan. Standard SMS and data rates charged by your carrier may apply to each message sent or received.

Clear AI Studio does not charge you directly for receiving text messages. Any costs are between you and your mobile carrier. Contact your carrier if you are unsure about your plan's SMS rates.

How to Opt Out (Unsubscribe)

You may opt out of any Clear AI Studio messaging program at any time using any of the following methods:

Text STOP — Immediate Opt-Out

Reply STOP to any message you receive. You will receive one final confirmation, and no further messages will be sent from that program to that number.

You reply: STOP You receive: "You have been unsubscribed from Clear AI Studio messages. No further messages will be sent. Reply START to resubscribe."

Other Opt-Out Methods

  • Email [email protected] with your phone number and "UNSUBSCRIBE"
  • Submit the contact form at ClearAIStudio.com/contact
  • Call us during business hours (see Section 13)
⚠ Important — Multiple Programs

Opting out of one program does not automatically opt you out of all programs. If you receive messages from multiple businesses using our platform, you must reply STOP separately for each sender number, or contact us to remove your number from all programs at once.

Resubscribing

To receive messages again after opting out, reply START to the same number or re-submit your consent through the relevant opt-in form.

Section 06

No Sharing of Phone Numbers

We will not share, sell, rent, or transfer your mobile phone number to any third party for their own marketing purposes.

Your phone number may only be disclosed to the following service providers, strictly for delivering messages you have consented to receive:

  • Twilio — SMS delivery infrastructure
  • GoHighLevel (GHL) — CRM and automation platform managing contact records and message scheduling
  • The Campaign Registry (TCR) — for 10DLC brand and campaign registration verification

All third-party providers are contractually bound to use your data only for the purpose of delivering our messaging services and are prohibited from using it for their own marketing.

Your phone number is never sold. It is never shared with advertisers. It is used only to deliver the messages you explicitly consented to receive.

Supported Carriers

Our messaging programs are supported by all major U.S. carriers. Carrier support may vary for smaller regional carriers.

  • AT&T
  • Verizon
  • T-Mobile (including Sprint)
  • US Cellular
  • Cricket Wireless
  • Boost Mobile
  • Metro by T-Mobile
  • Other regional and MVNO carriers

If you experience issues receiving messages, contact your carrier to ensure SMS from short codes and 10-digit long codes are not blocked on your account.

Types of Messages We Send

The following message categories may be sent through our platform depending on the program you have opted into:

  • Appointment confirmations and reminders — confirming a booked appointment and reminding you before it occurs
  • Lead follow-up — responding to inquiries submitted through web forms, missed calls, or social media
  • Marketing promotions — special offers, seasonal promotions, and service announcements from businesses you have opted in to hear from
  • Review requests — requesting feedback after a completed service or appointment
  • Customer care responses — answering questions you have sent via text
  • Recall and reactivation — reaching out to reconnect after a period of inactivity
  • Transactional notifications — receipts, booking changes, cancellations, and other account-related updates

You will only receive message types you have explicitly consented to at opt-in.

Section 09

How We Obtain Consent

Clear AI Studio only sends automated text messages to individuals who have provided express written consent. We obtain consent through the following methods:

Web Forms

All web forms that collect a phone number and may trigger SMS communications include an unchecked opt-in checkbox with the following language (or equivalent):

"I agree to receive text messages from [Business Name] at the phone number provided. Message frequency varies. Message & data rates may apply. Reply STOP to unsubscribe. Reply HELP for help. View our SMS Terms & Privacy Policy: [link]"

The checkbox is unchecked by default. Pre-checked boxes do not constitute valid consent under TCPA and are never used.

Verbal Consent (Voice AI)

When a caller interacts with our Voice AI receptionist and confirms they would like to receive a confirmation text, that verbal confirmation is recorded and timestamped as the consent event.

Consent Records

All consent events are recorded with a timestamp, IP address (for web forms), source URL, and the exact consent language displayed at the time of opt-in. These records are retained for a minimum of 4 years.

⚠ No Purchased Lists

We never send automated SMS messages to purchased, rented, or scraped contact lists. Every recipient has explicitly opted in. This is non-negotiable and applies to all clients using our platform.

Section 10

HIPAA & Medical Business Clients

For clients in healthcare-adjacent industries — including dental clinics, medical spas, chiropractors, mental health practices, and IV therapy clinics — Clear AI Studio offers HIPAA-compliant messaging configurations.

What this means

  • Messages sent through HIPAA-configured programs do not include protected health information (PHI) in SMS content
  • Appointment confirmations reference dates and times only — not diagnoses, treatments, or specific procedures
  • Patient phone numbers are handled under a Business Associate Agreement (BAA) with applicable platform partners
  • Data storage and transmission practices meet HIPAA minimum necessary standards

Client responsibility

Business clients using our platform for healthcare communications are responsible for ensuring their own HIPAA compliance, including obtaining proper patient authorizations for any messaging that may involve PHI. Clear AI Studio configures the technical safeguards; the covered entity remains responsible for regulatory compliance.

✦ Required for Medical Clients

HIPAA-compliant messaging is required — not optional — for any business handling protected health information. If you are a medical client and have not yet confirmed your HIPAA configuration with our team, contact us immediately before sending any patient-related messages.

Section 11

Privacy & Your Data

Your phone number and any information collected in connection with our messaging programs is governed by our Privacy Policy, which is incorporated by reference into these SMS Terms.

Key points specific to SMS data:

  • Phone numbers collected for SMS programs are used only for that program — they are not added to unrelated marketing lists without separate consent
  • You may request deletion of your phone number from our systems at any time by contacting us (see Section 13)
  • Opt-out records are retained even after deletion requests to ensure we honor your opt-out permanently
  • Message logs (content and metadata) are retained for up to 90 days for troubleshooting, then purged
Section 12

Changes to These Terms

Clear AI Studio reserves the right to update these SMS Terms at any time. When we make material changes, we will:

  • Update the "Last Updated" date at the top of this page
  • Post notice on our website for at least 30 days before changes take effect
  • Where required by law, notify active SMS subscribers of material changes before they take effect

Continued participation in any messaging program after the effective date of updated terms constitutes acceptance of those terms. If you do not agree with updated terms, reply STOP to opt out at any time.
